Can you dismiss an employee for absconding via SMS?
Sending a dismissal by SMS without trying to reach the employee first is risky and often found unfair.
Absconding means the employee has left work with no intention of coming back. The employer must first make real attempts to reach them: phone calls, messages to their next of kin, and a written letter asking them to return or explain.
If they do not respond, the employer should invite them to a hearing, even if they are absent. A dismissal letter can then be sent by SMS, WhatsApp or email, keeping proof of delivery.
If the employee comes back with a good reason (illness, arrest, family emergency), the employer should listen before finalising the dismissal.
