CCMA referral deadline rules

Unfair dismissal: 30 days from the dismissal date. Unfair labour practice: 90 days. Unfair discrimination: 6 months.

An unfair dismissal dispute must reach the CCMA within 30 days of the date of dismissal or the date the employer made a final decision to dismiss.

An unfair labour practice dispute (for example promotion, suspension or training) must be referred within 90 days. Unfair discrimination disputes have 6 months.
